Terms of Service

These Terms of Service ("Terms") apply to your use of (a) the Primestreak website at primestreak.no and related web properties, (b) the Primeportal platform and related services (the "Platform"), and (c) any associated features, accounts, integrations, and content. By accessing or using any of these, you agree to these Terms. If you do not agree, do not use the services.

2. Operator

The Primestreak website and the Primeportal platform are operated by Primestreak. References in these Terms to "we," "us," or "our" mean Primestreak.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Platform. You are responsible for (a) providing accurate and complete account information, (b) maintaining the confidentiality of your account credentials, and (c) all activities that occur under your account. You must notify us promptly of any unauthorized use of your account.

4. Acceptable use

You may not misuse the website or the Platform. You agree not to: use the services for any unlawful purpose or in violation of any applicable law; abuse, harass, or harm others; interfere with or disrupt the services or infrastructure; scrape, crawl, or use automated means to access the services without our permission; gain or attempt to gain unauthorized access to any system, account, or data; upload or transmit harmful, offensive, or illegal content; or attempt to circumvent access controls or security measures. We may suspend or terminate access for conduct we consider unacceptable.

5. User content

You retain ownership of content you upload or create through the services ("User Content"). By submitting User Content, you grant Primestreak and Primeportal a limited, non-exclusive, royalty-free, worldwide license to host, store, process, display, and transmit that content as necessary to provide, operate, and improve the services. This license ends when you remove the content or close your account, except where retention is required by law or for backup/safety.

6. Third-party integrations

The Platform may connect to third-party services (e.g. Instagram, Meta, or other social or business platforms). You are responsible for ensuring you have the right to connect your accounts and to use those third-party services in accordance with their terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services. Your use of such services is subject to their respective terms and privacy policies.

7. Availability and service changes

We provide the services on an "as is" and "as available" basis. We may change, suspend, or discontinue features or the service as a whole, and we may impose limits or conditions. We will use reasonable efforts to communicate material changes where appropriate but are not obligated to do so in all cases.

8. Fees and subscriptions

Some parts of the services may be subject to fees or subscriptions. If we offer paid plans, we will make the applicable pricing and payment terms available (e.g. on the website or within the Platform). Payment terms may include billing cycles, renewal, and cancellation. We may change fees with notice where required by law or as stated in the applicable plan.

9. Intellectual property

Primestreak and Primeportal names, logos, branding, software, and platform materials are our property or our licensors'. Unless we expressly grant you rights (e.g. in a separate agreement), you do not acquire any right, title, or interest in our intellectual property. You may not copy, modify, or use our branding or materials for purposes other than using the services in accordance with these Terms.

10. Termination

We may suspend or terminate your access to the website or the Platform, or to specific features, without notice, if we believe you have breached these Terms, misused the services, created a security or legal risk, or where required by law. You may stop using the services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

11. Disclaimers

The services are provided "as is" and "as available." We do not guarantee that the services will be uninterrupted, error-free, or free of harmful components. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

12. Limitation of liability

To the maximum extent permitted by applicable law, Primestreak and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or in connection with your use of the services. Our total liability for any claims arising under or in connection with these Terms or the services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred (100) euros if no fees were paid. Some jurisdictions do not allow certain limitations; in such cases our liability will be limited to the fullest extent permitted by law.

13. Privacy

Your use of the services is also governed by our Privacy Policy. By using the services, you consent to the collection, use, and disclosure of information as described in that policy. Please read our Privacy Policy for details.

14. Governing law

These Terms are governed by the laws of Norway, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Norway, unless mandatory consumer law in your country requires otherwise.
